Sponsor. Jim's Formal Wear, LLC (“Sponsor), 804 East Broadway, Trenton, IL 62293.
Eligibility. Subject to the additional restrictions below, the Jim's Formal Wear Michael Kors Purse Giveaway (the “Giveaway") is open to legal residents of the United States who are 18 years or older at the time of entry. Employees of Jim's Formal Wear and each of their respective affiliated companies and subsidiaries and the family members of any such employees are not eligible to enter or to win. The term “family members" includes spouses, parents, grandparents, siblings, children, grandchildren and in-laws, regardless of where they live.
Giveaway Period. The Giveaway will begin at 5:30 p.m. ET on Monday, October 23, 2023 and end at or about 7:00 p.m. ET on Tuesday, October 24, 2023 (the “Giveaway Period"). Sponsor will be the official timekeeper for the Giveaway.
How to Enter. To enter, visit Jim's Formal Wear 2023 BBG Seminar at SaddleBrook Resort, 5700 Saddlebrook Way, Wesley Chapel, FL, during the Giveaway Period to fill out an official entry form. The Sponsor will draw one winner at the end of the day on Monday, October 24 (pending they meet all eligibility requirements). Sponsor reserves the right to disqualify any entries by persons who submit false or misleading entry information or who Sponsor determines to be tampering with or abusing any aspect of the Giveaway.
Limit on Entry. One (1) entry per person each day during the Giveaway Period. Maximum of two (2) entries per person during the Giveaway Period.
Winner Selection and Odds. A random drawing from among all eligible entries will be done on Tuesday, October 24, 2023, at or near 7:00 p.m. ET each day to determine which entry will be awarded the prize. Odds of winning depend on the number of eligible entries received. Each person may re-enter each day during the Giveaway Period. Limit: One (1) prize per person and per household.
Prize. A total of one (1) prize will be awarded, subject to verification of eligibility and compliance with these Official Rules. The prize winner will receive a Michael Kors designer purse. The style is subject to availability at the time the winner is contacted. Total approximate retail value of each prize is $200. Purse images on promotional pieces are not necessarily representative of the style availability.
Winner Notification and Acceptance. Potential winner will be notified by phone at the number provided on the official entry form. To claim his/her prize, the potential winner must answer or return the Sponsor's phone call to give their information and pick their purse within 3 business days after notification of winning the prize. Winners will be contacted in the order that they were deemed as a winner, but the purse selection is based on the time the winner makes contact with the Sponsor.
Sponsor's inability to reach a potential winner by phone, the failure of a potential winner to timely respond to a prize notification, the return of any prize notification as undeliverable, and/or a potential winner's failure to comply with any term or condition of these official rules may, in Sponsor's sole discretion, result in the potential winner's disqualification and the selection of a substitute winner by a random drawing from among all remaining eligible entries received during the Giveaway Period. Sponsor will conduct up to two (2) alternate drawings, after which the prize will remain un-awarded.
A winner may waive the right to receive a prize. Prizes are non-assignable and nontransferable and cannot be redeemed for cash. No substitutions allowed by winner.
General Conditions: By participating, entrants agree (a) to be bound by these Official Rules and the decisions of Sponsor and its agents, which decisions shall be final and binding in all matters relating to the Giveaway; (b) that Sponsor, its parent companies, affiliates, subsidiaries, retailers, sales representatives, distributors, advertising/promotion agencies, and their respective officers, directors, employees, representatives and agents (individually and collectively “Releasees") are released, will have no liability whatsoever for, and shall be held harmless by entrants against any and all liability for any injuries, losses or damages, rights, claims and actions of any kind to person(s), including personal injury, death, or damage to or loss of property, or intellectual property, or rights of publicity or privacy, defamation, or portrayal in a false light, resulting in whole or in part, directly or indirectly, in connection with the acceptance, possession, misuse or use of the prize or participation in the Giveaway or any Giveaway related activity; (c) that they have read, understood and complied with these Official Rules; (d) entrants who do not comply with these Official Rules, or who attempt to interfere with this Giveaway in any way shall be disqualified; and (e) by acceptance of prize, except where legally prohibited, grants permission for Sponsor (and agrees to confirm such permission in writing) and those acting pursuant to Sponsor's authority to use, in perpetuity, and statements and prize information, for advertising, trade and promotional purposes without further compensation, at any times or time, in all media now known or hereafter discovered world wide, and on the Internet and/or World Wide Web, without notice or review or approval.
Liability Limitations. The Sponsor is not responsible for incorrect or inaccurate entry information howsoever caused or other error of any kind whether human, mechanical or electronic. Entrants found tampering with or abusing any aspect of this Giveaway, as solely determined by Sponsor, will be disqualified. If disqualified for any of the above abuses, the Sponsor may terminate entrant's eligibility to participate in the Giveaway. If this Giveaway is compromised by non-authorized human intervention or other causes beyond Sponsor's control which, in the sole opinion of Sponsor, corrupt or impair the administration, security, fairness or proper play of the Giveaway, the Sponsor may, at its sole discretion, suspend or terminate the Giveaway and will then award a prize, from all eligible entries received prior to (and after, if appropriate) the action taken by Sponsor.
The Sponsor is not responsible for any prize awards not delivered to the designated winner due to delivery problems associated with the United Parcel Service.
CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR'S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THAT PROVISION.
Governing Laws and Rules: Giveaway is void where prohibited and subject to all U.S. federal, state and local laws and regulations and these Official Rules. A copy of the Official Rules is available at www.jimsformalwear.com/michael-kors-purse-giveaway-rules. In the event of any inconsistency between Giveaway-related materials and these Official Rules, these Official Rules shall govern and control. This Giveaway, including construction, validity, interpretation and enforceability of these Official Rules shall be (1) governed by the laws of the State of Illinois without regard to choice of law or conflict of law principles (whether of the State of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Illinois; (2) any dispute, claims and causes of action arising out of or connected in any way with the Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and brought exclusively in a federal or state court in Illinois; (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, but in no event attorneys' fees; and (4) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
